ABSTRACT

Divorce or dissolution issues a major role, during a marriage or civil partnership because of financial gains and losses for the parties. The economic losses and gains are not been shared equally during the marriage, it seems only fair that the law ensures on divorce. There is a huge difference between the powers of the courts: when a court deals with the end of a marriage or civil partnership, and a case involving a couple who are simply living together. Some financial orders on separation are: a periodic payments order, property adjustment order, lump sum order, and pension sharing order. The courts will try to make a clean break order so there is no on going liability between the parties. A clean break is a financial order which means there is no on going financial responsibility between the parties. The statute lists factors that are to be taken into account in exercising the discretion.
