ABSTRACT

This chapter presents an overview of common/civil law, legislation/stature and key regulators in England. It talks about environmental damage regulations, environmental permitting and environmental civil sanctions regulations 2010. Environmental civil sanctions regulations provide an alternative to prosecution to secure binding and effective action to prevent or remediate pollution. For a specified list of offences, regulators are able to use alternative sanctions with legitimate businesses who are trying to do the right thing. Six types of sanction: Compliance Notice, Restoration Notice, Fixed Monetary Penalty, Variable Monetary Penalty, Enforcement Undertaking, Stop Notice. This chapter also explains international agreement, European legislation and UK legislation. International agreement such as the Montreal Protocol and Basel convention has been discussed in the sections on air pollution and waste. The chapter is the essential guide for students who preparing for the IEMA Associate Membership Exam and NEBOSH Diploma in Environmental Management.
