ABSTRACT

This chapter examines key policy, law and sport measures that operate to regulate inclusion and exclusion. It explains evaluation of the current 'toolkit' available for managing and dealing with inclusion and exclusion in sport. It analyses the impact of supervised autonomy on the regulation of inclusion and exclusion in sport and the protection of equality principles. At the international level exists sport tribunals such as Court of Arbitration for Sport (CAS) and the Federation Internationale de Football Association (FIFA) Dispute Resolution Chamber, the global anti-doping body World Anti-Doping Agency (WADA) and international sports federations (ISF) instruments such as the Olympic Charter, which each demonstrate the potential capacity to deal with aspects of inclusion and exclusion. The compatibility of the sport approach with domestic, regional and international legal mechanisms will be critiqued, drawing upon primary and secondary sources of law.
