ABSTRACT

Social media claims or potential claims may arise in almost any context, from branding and advertising issues to defamation and privacy claims, consumer class actions and securities claims. The Association of British Insurers (ABI) is using the report as a springboard to launch its 'Big Debate' within the industry and among other stakeholders on how to deliver better solutions for customers. The debate will likely focus on regulation, stimulating economic growth and infrastructure investment, welfare reform, paying for life after work, and the acceptable use and security of personal data now available. Businesses should also consider if their policies offer coverage for third-party loss. Claims may include allegations of violations of privacy rights and individuals personal data, duties to secure confidential personal information pursuant to statutory enactments, breaches by employees or others, infringement of intellectual property rights, unfair competition, defamation and consumer protection, and deceptive trade practices statutes.
