ABSTRACT
It is common practice for a party to a building contract to involve third parties in its performance either as recipients of some of his benefits or undertakers of his obligations under the contract. The common legal mechanisms whereby such third party involvement may be allowed include novation, assignment, and sub-contracting. This chapter first explains the general principles governing the operation of these mechanisms. Their intended operation under JCT 98 is then examined. 1
