ABSTRACT

It is stipulated in the Constitution of the People’s Republic of China that “all power in the People’s Republic of China belongs to the people. The mechanisms through which the people exercise state power are the National People’s Congress (NPC) and the local People’s Congresses.” The People’s Congresses exercise state power, and the National People’s Congress is the supreme state power. Unlike the system in the United States, the NPC is at the apex of the political system, and the executive and judicial branches of government are subordinate to it. As discussed elsewhere, however, the NPC is under the leadership of Communist Party of China (CPC).
