ABSTRACT

This chapter is concerned with the key reasons why the contractor may become entitled to extension of time, may also be entitled to payment for delay if it is for compensable reasons and may also be entitled to payment for expense or, under the Joint Contracts Tribunal arrangements, for loss and expense. The significance of delay is that it leads either to the contractor being liable to concede liquidated damages to the employer, or to the employer having to concede extension of time for completing the works to the contractor. Any disturbance that may be reimbursable to a contractor may be complicated by the presence of other, overlapping, disturbance that, while causing loss and expense to the contractor, does not qualify for reimbursement by the employer. Although disturbance may be seen as disruption or prolongation, separately or together, it occurs in various patterns.
