ABSTRACT

This chapter looks at the Joint Contracts Tribunal (JCT) and IFC main and subcontract forms only. The JCT clause is explicit that the contractor is to state the matter or matters causing his loss and expense, and this means that he must make a separate application for each matter which leads to distinct loss and expense. The alternative temptation for a harassed contractor, frequently resorted to, is to put in an application every time that anything happens, be it even a revised drawing issue of the most minor variety. The line and direction of communication set out in the JCT forms over subcontract loss and expense are quite clear: the subcontractor in all cases deals primarily with the contractor. When there are domestic and named subcontractors, the contractor alone deals with the subcontractor concerned in any instance.
