ABSTRACT

This chapter deals with the contract control of the various types of subcontractors within a Joint Contracts Tribunal context. The subcontractor should look carefully for the underlying motive, as it usually increases his responsibilities, probably over design and other liabilities towards the employer by way of some collateral warranty. A quotation from the nominated subcontractor for the frame had been obtained in advance and, in a special condition, showed erection at an earlier stage with a cleared site. Nomination was made by a ‘variation order’ accompanied by the quotation and special condition. The process of naming is akin to nomination, in that the architect puts a specific person to the contractor for acceptance. Also, if the subcontractor drops out during progress, the architect is involved in selecting and naming a substitute and the amount payable by the employer may change as a result.
