Introduction to the three certainties In Chapter 1, we saw that an express private trust is one that is created expressly for the benefi t of an individual or a class of individuals, e.g. ‘for my employees’. In order to create such a trust, there are a number of requirements – the fi rst of these was identifi ed by Lord Langdale in Knight v Knight [1840] as the three certainties. This is a popular examination area.
