ABSTRACT

Judith Jarvis Thomson has recently defended preferential hiring of women and black persons in universities.1 She restricts her defense of the assignment of preference to only those cases where candidates from pre­ ferred groups and their white male competitors are equally qualified, al­ though she suggests that her argument can be extended to cover cases where the qualifications are unequal as well. The argument in question is compensatory; it is because of pervasive patterns of unjust discrimination against black persons and women that justice, or at least common decency, requires that amends be made.
