The three certainties

For a valid express trust a key requirement is to satisfy the three certainties (Knight v Knight (1840)):

Certainty of intention — the donor must intend to create a trust.

Certainty of subject matter — there must be identifiable property over which the trust can operate.

Certainty of object — there must be identifiable human beneficiaries who can enforce the trust.
