On 25 July 1997, the United States (US) Senate unanimously passed the Byrd-Hagel Resolution, which determined that the Kyoto Protocol, then still under negotiation, should not be ratified. 1 As a result, the Protocol itself was never submitted to the Senate for ratification. America was therefore excluded from emissions trading under the Protocol.
