ABSTRACT

Wars must end and so must the nation-state that produces them. This chapter argues for a world without borders and without exclusionary politics. Since the expansion of judiciary powers within nations was central to taming violent intra-national conflict, the expansion of peaceful courts to settle disputes can replace the reliance on war as the means for dealing with conflict between nations as well. This chapter also considers a transformative new model for the judiciary. Courts will serve to enforce all equalities—not merely those of economics, but also those of love and attention. Since attention and love are not limited commodities, judgments rendered will no longer be zero-sum punishments, with a winner and loser. Instead, courts will seek to address any imbalance in love and attention, thereby restoring the virtuous cycles of love and compassion that are possible among humans. The chapter also discusses the fundamental principles upon which Utopia will be based, and how experimentation with new models can be an invigorating process within Utopia.
