ABSTRACT
This chapter explores important human rights related declarations, covenants, articles on the environment and if humans have rights to environment. The Stockholm Declaration forged a universal basic outlook among various nation-states, so they could come to a consensus on broad environmental policy goals and objectives. The declaration was meant to be a guideline for governments and peoples “to exert common efforts for the preservation and improvement of the human environment, for the benefit of all the people and for their posterity”. The Stockholm Declaration initiated the process of integrating international law and environmental law. Human rights law in this context should safeguard conditions and environmental quality in order to protect “the substantive rights to life, the rights to health, the rights to a family and private life, the rights to culture, and other human rights”. Article 8 of the European Convention guarantees the right to private life and the home and is often applied in court cases.
