ABSTRACT

Tort law is a body of law that looms large in the minds of medical professionals, others engaged in risky activities, and makers and sellers of products that present some degree of danger to consumers and others who may encounter those products. Generally, a consumer disappointed by a product must show, in one way or another, that it had a defect. Tort law is the body of law that governs actions for injuries claimed to be caused by behavior that is wrongful or otherwise regarded as unjust if it causes injury. Torts involve invasions of personal physical and mental security, interests in property, and some other kinds of economic interests. Shorthand of a principal rationale for imposing tort liability is "deterrence"—that is, controlling behavior by imposing money costs on those who engage in risky activities. Tort theories of liability for misrepresentations begin with the most culpable—fraud, or untrue statements made recklessly of their truth or falsity.
