ABSTRACT

In South Africa the ‘Commission of Truth and Reconciliation’ is ready to hear everything without judging, on the condition that it is a matter of crimes concerning apartheid and not other offences. In South Africa democracy finds itself founded in a different way from what we are familiar with. We act as if the classification into vanquishers and vanquished, analogous to the dominant/dominated split, was obvious, although in South Africa the participants in the meeting to establish the 34 principles rightly agreed beforehand that there could not in the end be any winners or losers. If in theory, the two coincide and the sovereign exercises the power, C. Salazar says, however, in practice, the sovereign delegates to his representatives, the deputies, the effective exercise of the sovereignty and gives the parliament the right of – that’s the sense of the word – speaking for him.
