ABSTRACT

The land issue in the Southern African Development Community (SADC) is a typical example of past and continuing social injustices that are rooted in colonial of some States. The SADC’s preferred tool for resolution of the land issue – humwe – must be examined first for its potential to enable States to resolve the mischief, and secondly, for its consistency with international morality. Its human rights credentials and social justice agenda strongly recommend it for application in the effort to resolve the land issue. The land issue for instance is packaged with international law properties in that both colonialism and its rejection were matters of international law. Local knowledge of the land issue in the SADC might be a basis for the view that those directly involved in the situation should determine the way forward.
