ABSTRACT

This chapter highlights the fact that everybody will be affected by the changes in the way retirement is managed. The Government has proposed a national default retirement age of 65, when employers will be able to retire workers. From 1 October 2006 employers are not able to retire employees below their organization's Normal Retirement Age (NRA) or where there is no normal retirement age, below 65. Planned retirement is a new concept whereby the employer must give 6–12 months' written notice of the date of retirement. Where an employee is granted leave to stay on at their post beyond the default retirement age they will still be protected by continued employment rights such as discrimination policy and unfair dismissal. One of the options available is flexible and phased retirement, which in our experience is popular with both organizations and individuals.
