ABSTRACT

This chapter shows that the Subdivision Regulations shall be known and cited as the impact fee regulations. For each category of public facility for which an impact fee is established, the local government shall first designate the boundaries of a service area within which impact fees shall be imposed and collected. For purposes of collecting and expending impact fees, the local government shall establish as necessary to assure that the expenditure of the proceeds of impact fees on those capital improvements identified in the capital improvements program directly benefits each new development that pays impact fees within the subarea. Land development creates the need to expand public services and install public improvements and facilities. The need to ensure that development pays its required share of the cost of capital facilities has led government to adopt development requirements known as exactions. Exactions adopted through subdivision regulations include dedication, money in lieu of dedication, impact fees, linkage fees, and special facility benefit assessments.
