ABSTRACT

On 1994, the President of the United States, Bill Clinton, issued Executive Order 12898, which directed all US federal agencies to develop a strategy that "identifies and addresses disproportionately high and adverse human health or environmental effects of its programs, and policies. The executive order required the US Department of Justice to promote the equal enforcement of all existing civil rights, health, and environmental statutes. Environmental justice is defined by the US Environmental Protection Agency both in terms of fair treatment, but also in relation to the meaningful involvement of people in decision-making – all people, regardless of race or ethnicity, gender or sexuality, origin or income. The European Union has taken environmental justice seriously, and even ClientEarth claims that no individual or campaign group has ever been given permission to bring an environmental case against an EU institution to the European Court of Justice.
