ABSTRACT

Chapter 5 examines cases of former British colonies that have successfully decriminalized homosexual conduct. Examples include Hong Kong, South Africa, Fiji, Belize, Cyprus, and Seychelles. In each case we look at how the laws were enacted historically and then trace the process of decriminalization in each’s political context. In particular, we pay attention to the different pathways through which decriminalization occurred, whether through court cases or through legislative reforms following constitutional changes. Special attention has also been paid to LGBT groups that have fought hard to remove these legal restrictions on homosexuality, and the social political implications of such positive changes.
