ABSTRACT

This chapter examines the various regulatory structures that States have adopted to regulate drone use. It also identifies common features and unique differences across jurisdictions both federal and unitary. Privacy has always been a fundamental public concern and the rise of drones has only exacerbated such concern. There is clear difficulty in maintaining an acceptable level of privacy given the relative ease with which a suitably equipped drone can breach that privacy. The European Union has directly implemented privacy requirements in its proposed regulation for drones. A common issue for federal systems is possible inconsistency of privacy laws at the state and local levels. These issues, of course, are not faced by unitary systems where one set of laws apply. Drone regulations are a national issue concerning individual jurisdictions. International Civil Aviation Organisation (ICAO) has been working on harmonising regulatory requirements and the principles underlying them.
