ABSTRACT
If the defence challenge the version of events put forward by the prosecution, and the difference is one which will affect the sentence that is passed, the court can only reject the defence version of events after hearing evidence as to what happened. Such a hearing is known as Newton hearing (from R v Newton (1982) 77 Cr App R 13) and is described more fully later, in Chapter 12, 12.1.1.
