ABSTRACT

This concept can apply in both criminal law and the law of tort, but more usually in the latter. A distinction is drawn between an employee who works for an employer under a contract of service and an independent contractor who is employed under a contract for services. An example of the latter would be where A employs B to paint A’s house and it is left to B’s skill and judgment as to how he tackles the job. B will also usually supply the tools and materials and may well have employees or subcontractors working for him to complete the job.
