Section 85 of the Copyright, Designs and Patents Act (CDPA) 1988 sets out a narrow right of privacy in the following terms:
There are a few exceptions to the right which are set out in s 85(2) of the CDPA, most notably for the incidental inclusion of the work in an artistic work, film, broadcast or cable programme.15
