ABSTRACT
This Act was passed as a result of the unsatisfactory state of the law regarding legal proceedings against the Crown. Its main object was to place the Commonwealth or a State in the same position, as far as possible, as a private person or employer, that is, able to sue and be sued for breaches of contracts or for torts committed by servants. The Act does not affect the Queen’s personal immunity from legal proceedings.
