ABSTRACT

Some important classes of contracts are specifically excluded from the Act. These include contracts of insurance,133 contracts of employment (except in favour of an employee),134 and contracts for the international supply of goods.135 Apart from s 2(1), the Act does not apply to contracts of marine salvage or towage, commercial charterparties136 or to contracts of the carriage of goods by sea.137 Any part of a contract relating to the creation or transfer of an interest in land,138 intellectual property139 or the creation or transfer of securities140 is also exempt.
