ABSTRACT

The topic of misrepresentation is introduced in Chapter 8, which deals with the terms of a contract and explains how some statements made in the course of negotiations fall short of terms and are categorised as ‘mere representations’. If representations that are made to induce a party to enter into a contract turn out to be false, no action lies for breach of contract. However, a remedy may be available for misrepresentation.
