Normally, a lease cannot be frustrated, as it creates not a mere contract, but an estate in land. For example, in London and Northern Estates Co v Schlesinger,20 it was held that the lease of a flat was not terminated by the fact that the lessee became an enemy alien and was thereby prevented from living on the premises.
