ABSTRACT
At one time, it was thought that only damages for pecuniary loss could be awarded in contract. Although reluctant to award damages for non-pecuniary loss, the courts have clearly shown that they may be awarded in certain limited cases. Thus damages may be recovered for: • substantial physical inconvenience or discomfort;66
• mental distress, for example, injured feelings or disappointment.
