ABSTRACT

A covenant precluding assignment and sub-letting (alienation), alterations or a change of user may be expressed as an absolute restriction, or be qualified by requiring the landlord’s prior consent. Various statutes, in particular the Landlord and Tenant Acts of 1927 and 1988 and the Landlord and Tenant (Covenants) Act 1995, affect the legal position where a tenant seeks the consent of the landlord to any of these matters.
