Although Lord Atkin in Donoghue v Stevenson74 spoke of a duty to take care to avoid acts or omissions which were foreseeably likely to injure one’s neighbour, it is established principle that there is no general duty to act positively for the benefit of others75 and ‘there is no liability for a mere omission to act’.76
