ABSTRACT

The first matter to consider is whether the proposed lease relates to residential premises, business premises or an agricultural holding. It is essential to establish which of these three applies, because the law relating to each is fundamentally different and the style of preparing the lease is different. Most large firms of conveyancers possess precedent forms which can be used. If it is practical, it is often sensible to visit the premises in respect of which the lease is to be granted. This helps one to establish the rights that are required for the passage of services and mutual rights of support maintenance and rights of way.
