ABSTRACT
This largely replaces the previous originating summons. Regard should be had to the relevant Tables (see below) and rules to determine whether an action should be commenced using Part 8 rather than Part 7. The claimant must state on the claim form that Part 8 applies, and that he seeks a decision not involving a substantial dispute of fact; or a Practice Direction permits, or requires, ‘Part 8 Procedure’. A copy of the Part 8 claim form is given below, Chapter 24.
