ABSTRACT
A plea in mitigation is a submission made by counsel to reduce the expected severity of the sentence. In the lower courts, where the judges have to deal with convicted criminals in such large numbers, defence counsel know that judges often have their minds made up about sentence before they hear from counsel. So, it is part of counsel's function to persuade the judge to hand down a sentence different from the one which the judge may already have decided upon.
