ABSTRACT

The majority of residential possession applications are unopposed. These are listed in large numbers in what are often known as ‘short’ or ‘undefended’ possession lists. The courts hear dozens of applications in the course of a morning or afternoon. The expectation is that no case will take longer than five minutes, if that. If any hint of a triable issue emerges, the case will almost certainly be adjourned to a date when more time is available.
