ABSTRACT

In the last quarter of a century particular difficulties have arisen in the context of competition law. Most advanced capitalist states have some form of competition law designed to curtail restrictive practices, abuses of monopoly power and the various forms of cartel. The United States has had such legislation since the end of the 19th century.160 While there can be no objection when jurisdiction is founded on territory or nationality difficulties have arisen where jurisdiction is exercised under the terms of the ‘effects doctrine’.
