ABSTRACT

We now turn to all tenancies and leases within the Act granted after the Act’s start up date, 1 January 1996, except, the reader will remember, those granted pursuant to an agreement, option, pre-emption right and court order in existence before that date or when an overriding lease follows on an old lease.This means, for example, that an order from the court for a new business lease made before the cut-off date gives rise to an old lease, even if not completed until afterwards, whilst one granted pursuant to an order after that date, as a new tenancy, must expressly take into account the changes we are now going to deal with.
