Nuisance comprises two separate torts: public and private nuisance.

Private nuisance

Private nuisance is an unreasonable interference with a person’s use or enjoyment of land.

Parties Claimant Given that nuisance is a tort that protects the use or enjoyment of land, it used to the case that the claimant had to have a legal or equitable interest in the land affected: Malone v Laskey (1907).
