ABSTRACT
The doctrine of the separation of powers notwithstanding, it is now legitimate for the Legislature to delegate legislative powers to make laws to a subordinate authority.1 The Legislature exercises its discretionary power by conferring discretionary law making power on a subordinate authority. It is a method by which the Legislature leaves the detail provisions required under an Act of Parliament to a Minister, in effect to departmental officials.2
