As the concept of unfair prejudice is potentially very wide, to attempt to lay down a general definition would restrict the proper application of the remedy. The courts have rightly refused to place any ‘gloss’1 on the very wide discretion conferred on them by the section. Nonetheless, it is difficult to predict how the courts will exercise their discretion in applying the test without referring to decided cases.
