ABSTRACT
Sometimes a party breaches a condition of the contract or, in the case of an innominate term, breaches the term in a way that amounts to a repudiation of the contract. In either case, the innocent party may affirm the contract and sue for damages or may accept the other party’s repudiation and may regard himself as discharged from any further obligation under the contract (see Chapter 7).
