ABSTRACT
Once the claimant has established that the defendant owed him a duty of care, he has a second hurdle to get over. He must show that the defendant has actually breached the duty. Whether a duty of care has been breached involves consideration of two questions: (a) what standard must be reached?; and (b) has the defendant, in fact, fallen short of the required standard?
