ABSTRACT

A process falls under Pt I of the EPA 1990 only in so far as its conduct may lead to the release of certain prescribed substances into the environment as a whole (IPC) or into the air (LAAPC).1 Prescribed substances are those listed by the Secretary of State in Sched 4 (releases into the air), Sched 5 (releases into water) and Sched 6 (releases on to land). The Regulations require the best available technology not entailing excessive cost (BATNEEC) to be used to prevent or minimise releases of prescribed substances, or to render such releases harmless.
