ABSTRACT

A discharge consent granted to Welsh Water for the discharge of sewage from Tenby was the subject of a judicial review application in R v National Rivers Authority ex p Moreton (see p 331, below).53 A new consent requiring sewage to be pumped by a pipeline to a point 2.7km from land (it had previously been discharged at a point just below low water) was challenged by a swimmer who wanted the new consent quashed and an injunction because the NRA had not required ultraviolet disinfection as a condition of consent. The application was dismissed, the court stating that it was a proper exercise of the NRA’s discretion to take into account Welsh Water’s financial limitations when considering the benefits of ultraviolet disinfection.
