ABSTRACT
Finally, the ECJ in Arco and Epon said that whether substance is waste must be determined in the light of all the circumstances, having regard to Art 1(a) WFD, the general aim of the Directive and the ‘need to ensure that its effectiveness is not undermined’. This broad interpretative approach is designed to ensure that waste is dealt with without endangering human health or the environment.
