ABSTRACT

The authors have set out below the obligations which the prosecution can expect of a defence advocate. The sources of the materials are primarily the Solicitor’s Code of Conduct and the Code of Conduct for the Bar of England and Wales (6th edn) and case law where indicated. The overall objective of both codes must be to lay down standards of professional practice. To quote from the CCBE (the Council of the Bars and Law Societies of the European Community) reported in the LSG, 28 June 1989, Code of Conduct 1.2.2: ‘The particular rules of each bar and law society nevertheless are based on the same values and in most cases demonstrate a common foundation.’
