ABSTRACT
This chapter sets out the following legislation together with relating checklists identifying the elements and other investigatory matters:
1 Section 92 of the Trade Marks Act (TMA) 1994; 2 Section 107 of the Copyright Designs and Patents Act 1988 (criminal liability for
making or dealing with infringing articles, etc); 3 Section 198 of the Copyright Designs and Patents Act 1988 (criminal liability for
making, dealing with or using illicit recordings); 4 Section 1 of the Trade Descriptions Act 1968 (prohibition of false trade descriptions); 5 Sections 14 and 23 of the Trade Descriptions Act 1968 (s 14 false statement as to
services, etc); 6 Section 4 of the Business Names Act 1985 (failure to display name and address in
a prominent place in the business premises); 7 Section 1 of the Mock Auctions Act 1961 (conducting a mock auction); 8 Section 20 of the Consumer Protection Act 1987 (misleading price indications); 9 Regulation 4 of the Package Travel, Package Holidays and Package Tours
Regulations 1992 (misleading descriptive matter in packages); 10 Regulation 13 of the General Product Safety Regulations 1994 (offering or agreeing
to supply a dangerous product).
