Generally, the law might now be said to prevent interference in the right of the individual to become a parent. From the decision in Roe v Wade,10 where the US Supreme Court held that a woman’s reproductive rights were protected under the privacy clause of the Constitution, to Art 12 of the European Convention, which protects the right to found a family, the right to become a parent is as a general rule available to all.
